Case Study - Client Charged with Traffic and Drug Offences

Background

Our client was initially charged under section 60 of the Road Rules 2014 for a traffic offense, as well as charges for possession of marijuana and cocaine. Through effective representations to the police, we successfully had the possession charges withdrawn, allowing the case to proceed solely on the traffic offence charge. Our client had previously received a Section 10 dismissal for another drug related matter several years prior.


Legal Proceedings

Our office represented our client at the Local Court of NSW, Downing Centre. Our client entered a plea of guilty to the traffic offense. We presented several key documents to the court, including character references and a letter of apology from our client. Additionally, we provided an explanation regarding the confusing nature of the intersection where the offense occurred. We understand that you are human and honest mistakes do happen.


Court’s Decision

His Honour reviewed the submitted documents and was convinced by our submissions that our client made a reasonable mistake under extenuating circumstances. Our submissions painted our client in a good light and reflected his good character and genuine prospects of rehabilitation. Acknowledging these factors, His Honour issued one of the lightest possible sentences: A section 10(b) dismissal or better known as a conditional release order for a short period without any fine or conviction.


Outcome

This ultimately resulted in a minimal penalty, allowing our client to avoid any convictions and fines, and leaving him with the ability to drive home.
